Welcome to the Beach Fabulous website, operated by Beach Fabulous LLC (“Beach Fabulous”) and located at [https://www.beachfabulous.com] (the “Site”). The following terms and conditions (“Terms”) govern your use of this Site. By accessing, viewing, or using the content, material, or services available on or through this Site, you indicate that you have read and understand these Terms, that you agree to them, and intend to be legally bound by them. If you do not agree to these Terms, or if you are under 13 years of age, you are not granted permission to use this Site and must exit immediately.
1. Shipping Policy
Any and all orders placed through the Site are subject to this Shipping Policy. We strive for expedient delivery and aim to have most packages shipped within 48 hours. Many of our goods (especially made-to-order or customized items) are produced upon order, which may extend delivery times. Orders are not fulfilled on weekends.
Beach Fabulous bears no responsibility for the safety or delivery of products once they leave Beach Fabulous’s control and are transferred to the carrier. Any delivery issues must be resolved between the customer and the carrier in accordance with the carrier’s policies.
2. Pricing
Pricing on the Site is provided for informational purposes only and is subject to change or verification. While Beach Fabulous strives to provide accurate product and pricing information, errors may occur. Beach Fabulous cannot confirm the price of any product or service until an order is placed.
If a product or service is listed at an incorrect price or with incorrect information, Beach Fabulous reserves the right, at its sole discretion, to refuse or cancel any order. If payment has already been processed, Beach Fabulous will issue a refund for the canceled order.
3. Order Acceptance
Beach Fabulous reserves the right to refuse or cancel any order for any reason, including but not limited to quantity limitations, inaccuracies, or suspected fraud. Additional verification may be required before order acceptance. If your order is canceled after payment is received, a refund will be issued.
4. Returns and Exchange Policy
All orders placed through the Site are subject to our Return Policy, which is incorporated into these Terms by reference. Please review the Return Policy for full details.
5. Payment
Beach Fabulous uses third-party payment processors to handle transactions securely. Credit card information is encrypted using industry-standard SSL technology. You are responsible for all charges incurred under your account.
If payment is not successfully received, Beach Fabulous may suspend or terminate your account, seek collection of outstanding balances, or pursue legal remedies. You are also responsible for all applicable taxes associated with purchases made through the Site.
6. Proprietary Rights
All content on the Site—including text, images, graphics, logos, designs, and software (“Site Materials”)—is owned or licensed by Beach Fabulous and protected by intellectual property laws. You may not reproduce, distribute, modify, or otherwise use Site Materials without prior written consent.

You agree not to use the Site for any unlawful purpose, including but not limited to:
Violating intellectual property rights

The Site may include links to third-party websites. Beach Fabulous is not responsible for third-party content, products, or services, and use of third-party sites is at your own risk.

11. Disclaimer of Warranties
THE SITE AND ALL MATERIALS ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” BEACH FABULOUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACH FABULOUS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PRECEDING TWELVE (12) MONTHS, OR TEN DOLLARS ($10), WHICHEVER IS LESS.
13. Indemnification
You agree to indemnify and hold harmless Beach Fabulous and its officers, employees, and affiliates from any claims arising out of your use of the Site, violation of these Terms, or infringement of third-party rights.
14. Internet Security
While Beach Fabulous uses reasonable measures to protect the Site, uninterrupted or error-free access is not guaranteed. Data transmission over the internet may not be secure.
15. Complaint Procedures
If you believe your rights have been violated, contact CustomerService@BeachFabulous.com with a detailed notice including your contact information and a description of the alleged violation.
16. Changes to These Terms; Termination
Beach Fabulous may modify these Terms at any time. Continued use of the Site constitutes acceptance of updated Terms. Beach Fabulous may suspend or terminate access at its discretion.
17. Governing Law and Jurisdiction
These Terms represent the entire agreement between you and Beach Fabulous with respect to the subject matter hereof and supersede all prior or contemporaneous agreements, representations, and understandings.
These temrs are governed by the laws of the State of New York, without regard to conflict-of-law principles.
By accessing, viewing, or using the Site, you expressly consent and agree to:
(a) the exclusive jurisdiction of the state and federal courts located within the State of New York;
(b) accept service of process by personal delivery or mail; and
(c) irrevocably waive the right to a trial by jury and any objections to venue or jurisdiction that may otherwise be available.
18. Miscellaneous
The Site is operated from the United States. Access from jurisdictions where the Site is unlawful is prohibited. Failure to enforce any provision shall not constitute a waiver.
